A massive expectation has been created by the announcement of the signing of the Amendment Bills to give effect to the changes to the Acts. However, it is still premature to just take them as given. The amendments will only come into full effect once President Ramaphosa announces the relevant effective dates.
Once the announcement is made, we do need to ensure that the guidelines are in place in order to know how to claim this benefit from UIF. It is important to note that this is a UIF benefit, not one which is paid for by the Employer.
Further, the amendments apply to those who fall directly under the BCEA. The implication for employees falling under the jurisdiction of any Bargaining Council, Collective Agreement or Sectoral Determination still needs to be clarified by the respective body.
Provisions have been made for fathers who wish to take parental leave at time of the birth of their child but also covers adoption of children under 2 years of age and surrogacy agreements.
